Extradition/Article IV: Foreign Prosecution

What happens when a crime is committed in a local jurisdiction and the suspect flees to Mexico? If the suspect is a U.S. citizen, Mexico will most likely return the suspect to the U.S. under the Extradition Treaty between both nations. However, if the suspect is a Mexican citizen, Mexico will not allow extradition except under unusual circumstances. Acquaints viewers with the legal options available to U.S. jurisdictions under Article IV and the resources available in California for successful foreign prosecutions.

Extradition Procedures (LEOs Flying Armed)

Provides law enforcement officers training for the proper procedural planning and transport of a prisoner while flying armed. Training points are presented as step-by-step instruction for planning and carrying out an extradition, including: moving through the airport; interfacing with airline personnel/airport security; and controlling the positioning and in-flight time with a prisoner. The telecourse includes federal flying armed guidelines that satisfy the flying armed training required by the U.S. Department of Homeland Security/Transportation Security Administration for law enforcement officers (see special note below).

A checklist for extradition procedures is also included on the DVD as a downloadable PDF file. This document covers the guidelines for extradition including what to carry in an extradition kit, how to prepare the prisoner for flying, and how to utilize additional airport or law enforcement resources for transport.

This program was developed in conjunction with the U.S. Department of Homeland Security(DHS)/Transportation Security Administration (TSA)/Federal Air Marshal Service (FAMS) and meets all training requirements under the Code of Federal Regulation CFR 1544.219 in order for a law enforcement officer to fly armed in the performance of his/her official duties.

** ADDITIONAL REQUIREMENT EFFECTIVE NOV. 15, 2008 **
The TSA will begin transition to a National Law Enforcement Telecommunications System (NLETS) message for state and local law enforcement officers flying armed. The NLETS message sent by the employing agency will be in addition to the currently required original Letter of Authority. Failure to use the NLETS message may result in delays due to the additional verification requirements during the transition period. Hearsay Testimony

Focuses on hearsay testimony as it is given as part of a preliminary hearing under the guidelines of California’s Proposition 115. The program discusses the intent of Prop 115, the definition of "hearsay," the introduction of hearsay evidence at a preliminary hearing, and ten key considerations for Prop 115 hearsay testimony.

In addition to Prop 115 training, the program focuses on preparation for any courtroom appearance, whether it be for a preliminary hearing or jury trial. The video also covers some evidentiary rules governing the use of hearsay and some of the exceptions to the general ban on hearsay testimony that are important for officers to know in order to be a more effective witness.
